Community Property Laws determine what belongs to whom during a divorce proceeding.
According to these laws, all: Earnings, property purchased with those earnings, and debt incurred during the marriage is considered community property (i.e. both parties have claims to it).
Community Property Laws do not exist in every state in the U.S. However they are present in: California, Arizona, Nevada, Texas, New Mexico, Idaho, Wisconsin, and Washington.
