In 1973, New York's Governor, Nelson Rockefeller, signed drug laws that required judges to hand down mandatory prison terms for non-violent drug offenses. These laws are reportedly about to be repealed.
In a 96 to 46 vote, the Assembly approved legislation that would give judges the right to once again determine the sentencing for low-level drug-possession offenders. The legislation also comes with the stipulation that judges are no longer required to get the prosecutors' approval before they can sentence a person to drug treatment instead of prison.
In order for this legislation to become a law, it must first be approved by the Senate. The Democratic-Party lead Senate will reportedly give their approval of the legislation along with some amendments. Governor Paterson is also said to be in favor of passing the bill.
